Client Rights
As a client of kapilu Art Therapy, you have the following rights, consistent with Texas law and licensing board requirements.
Your Right to Know Who Is Treating You
You have the right to know the credentials of your provider. Kami Land holds the following licenses and certifications in the State of Texas:
Licensed Professional Counselor with Art Therapy Specialty Recognition (LPC-AT)
Licensed Chemical Dependency Counselor (LCDC)
Board-Certified Registered Art Therapist (ATR-BC)
You have the right to verify any license through the applicable state agency (see "Filing a Complaint" below).
Your Right to Informed Consent
Before services begin, you have the right to be informed, in writing, of:
Fees and payment arrangements
The purposes, goals, and techniques used in your counseling
Any restrictions currently placed on the therapist's license by a licensing board
The limits of confidentiality (see below)
Any intent to involve another provider in your treatment
If any of this information changes during treatment, you have the right to be informed of that change in writing before it takes effect.
Your Right to Confidentiality
Your communications and records are confidential and protected under Texas Health and Safety Code Chapters 181 and 611, and federal law (HIPAA). If you receive services related to substance use, your records may receive additional protection under 42 CFR Part 2. The specific limits of confidentiality — including legally required exceptions such as risk of harm to yourself or others, or suspected abuse of a child, elder, or dependent adult — are described in full in our Notice of Privacy Practices, which you will review before treatment begins.
Your Right to Ask Questions
You have the right to ask about the purpose, methods, and techniques used in your treatment, and to receive answers in plain, understandable language rather than clinical jargon.
Your Right to Refuse or Discontinue Treatment
You have the right to refuse any recommended treatment or technique, and to discontinue services at any time, for any reason. Discontinuing treatment does not affect your right to seek care elsewhere.
Your Right to Refuse Telehealth
Because all services at kapilu Art Therapy are provided via telehealth, you have the right to refuse telehealth services at any time. This refusal will not affect your right to future care where available, consistent with Texas Occupations Code Chapter 111.
Your Right to Be Free from Discrimination
You have the right to receive services free from discrimination based on race, ethnicity, national origin, religion, sex, gender identity, sexual orientation, disability, age, or any other protected status.
Your Right to a Second Opinion or Referral
You have the right to seek a second opinion from another provider at any time, and to request a referral if kapilu Art Therapy is not the right fit for your needs.
Filing a Complaint
You have the right to file a complaint if you believe your rights have been violated, without fear of retaliation. Complaints regarding licensure or ethical conduct may be filed with:
For LPC/LPC-AT licensure matters: Texas Behavioral Health Executive Council bhec.texas.gov
For LCDC licensure matters: Texas Health and Human Services Commission hhs.texas.gov
