Terms of Service

Welcome to the kapilu Art Therapy website (the "Site"), operated by Kami Land, LPC-AT, LCDC, ATR-BC ("kapilu," "we," "us," or "our"). By accessing this Site or engaging in services with us, you agree to the following terms.
1. Nature of Services
kapilu Art Therapy provides individual, couples, and family counseling services, including art therapy, delivered exclusively via telehealth (video-based sessions) to clients physically located in the State of Texas at the time of service. Services are provided by a Licensed Professional Counselor and are subject to the scope of practice defined by Texas licensing law.
2. Not for Emergencies
This Site and our telehealth services are not designed or intended for use in a medical or mental health emergency. If you are experiencing a life-threatening emergency, or having thoughts of harming yourself or others, call 911, go to your nearest emergency room, or call or text 988 (Suicide & Crisis Lifeline) immediately.
3. Informed Consent to Telehealth
By engaging in services, you acknowledge and consent to receiving care via telehealth, consistent with Texas Occupations Code Chapter 111. You understand:
Telehealth carries some limitations compared to in-person care, including potential technology interruptions.
You have the right to refuse telehealth services at any time, and this refusal will not affect your right to future care where available.
For minor clients, a parent or legal guardian authorized to make healthcare decisions for the minor must be present and provide consent at the initial appointment, consistent with Texas law.
4. Eligibility and Location Requirement
You must be physically located within the State of Texas at the time of each session, as Texas licensure law governs where services may be legally provided. You agree to notify your therapist if you are traveling outside of Texas, as this may affect the ability to provide services during that time.
5. No Guarantee of Outcomes
Therapy outcomes vary by individual, and we make no guarantees regarding specific results. Your active participation and honesty are important factors in the therapeutic process.
6. Payment, Cancellation, and Rescheduling
Session rates, accepted payment methods, and our cancellation/rescheduling policy are described on our Services & Rates page and in your client intake paperwork, and are incorporated into these Terms by reference.
7. Confidentiality
Confidentiality of your health information is governed by our Notice of Privacy Practices, applicable federal law (including HIPAA and, where applicable, 42 CFR Part 2), and Texas law (including the Texas Medical Records Privacy Act).
8. Website Content and Intellectual Property
All content on this Site — including text, graphics, logos, and the kapilu name and branding — is the property of kapilu Art Therapy and may not be copied, reproduced, or distributed without written permission. Content on this Site is provided for general informational purposes only and does not constitute clinical advice or create a therapist-client relationship until a formal intake and consent process has been completed.
9. User Conduct
If the Site includes contact forms or other interactive features, you agree not to submit false, abusive, or unlawful content, and not to use the Site for any unlawful purpose.
10. Limitation of Liability
To the fullest extent permitted by law, kapilu Art Therapy and Kami Land shall not be liable for any indirect, incidental, or consequential damages arising from use of this Site or from services provided, except as otherwise required by law or professional licensing standards.
11. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.
12. Changes to These Terms
We may update these Terms from time to time. Continued use of the Site or services after changes are posted constitutes acceptance of the revised Terms.
